When to update: Any time you change pricing, cancellation policy, add a new product or tier, change how matching works, update your refund policy, or make any material change to how the service operates. Update the "Last Updated" date every time you make any change.

Welcome to joinmailday.com (the "Site"), a website operated by MailDay LLC ("MailDay," "us," "our," and "we"). We provide the Site and the services provided through the Site (the Site and services will be collectively referred to as the "Services").

These Terms of Use ("Agreement") set forth the legally binding terms for your use of the Services. By accessing or using the Services, you are accepting this Agreement and you represent and warrant that you have the right, authority, and capacity to enter into this Agreement. If you do not agree with all of the provisions of this Agreement, do not access and/or use the Services. You may not access or use the Services or accept the Agreement if you are not at least 18 years old. All purchases and memberships must be made by a parent or legal guardian.

Privacy Policy

MailDay respects the privacy of its users. Please refer to our Privacy Policy at joinmailday.com/privacy-policy, which explains how we collect, use, and disclose information that pertains to your privacy, including information about children enrolled in our Services. When you access or use the Services, you signify your agreement to our Privacy Policy.

The Services

MailDay is a children's pen pal membership service that matches children ages 3–12 with pen pals and provides monthly digital activity packs. Memberships are purchased by parents and legal guardians on behalf of their children. By enrolling, you represent that you are the parent or legal guardian of the child you are enrolling and that you have the authority to consent to the terms of this Agreement on that child's behalf.

Membership Tiers. MailDay currently offers the following membership tiers:

MailDay Core (ages 6–12) — monthly or annual billing
MailDay Minis (ages 3–6) — monthly or annual billing
MailDay Homeschool Core (ages 6–12) — monthly or annual billing
MailDay Homeschool Minis (ages 3–6) — monthly or annual billing

Digital Packs. Monthly digital packs are delivered electronically. It is your responsibility to download and save your packs. MailDay is not responsible for any loss of access to digital content after delivery.

Pen Pal Matching. MailDay will use reasonable efforts to match your child with a pen pal within 21 days of enrollment. Matching is based on age, tier, and general interests. We cannot guarantee a specific match. If your child's match does not work out, you may request a rematch by emailing hello@joinmailday.com. The 21-day guarantee resets from the date a rematch is initiated.

Address Sharing. Pen pal matching requires the exchange of mailing addresses between matched families. By enrolling in MailDay, you consent to your child's first name and mailing address being shared with your child's matched pen pal family. Please refer to our Privacy Policy for full details on how we handle this information.

Accounts

Account Creation. To use our Services, you must register for an account and provide accurate, complete information as prompted. You represent and warrant that all registration information you submit is truthful and accurate and that you will maintain the accuracy of such information.

Account Responsibilities. You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account at hello@joinmailday.com.

Subscription and Billing

Recurring Billing. MailDay memberships are billed on a recurring basis — monthly or annually depending on the plan you select. Your subscription will automatically renew at the end of each billing cycle and your payment method on file will be charged automatically. By enrolling, you authorize MailDay and its payment processors (Shopify and ReCharge) to charge your payment method on a recurring basis until you cancel.

Pricing. Current pricing is listed at joinmailday.com. We reserve the right to change pricing at any time. We will notify you of any price changes by email before they take effect. Your continued use of the Services following notice of a price change constitutes your acceptance of the new pricing.

Founding Family Pricing. Members who enrolled during MailDay's founding period at a founding rate are grandfathered into that rate for the duration of their continuous membership. Founding pricing is lost if a membership is cancelled and later restarted.

Payment Information. You are responsible for providing a valid payment method and keeping your payment information current. You represent and warrant that you have the legal right to use any payment method you provide. All charges are processed by Shopify and ReCharge. MailDay does not store your credit card information directly.

Taxes. You are responsible for any applicable taxes associated with your membership.

Chargebacks. If you initiate a chargeback with your bank or credit card company without first contacting us to resolve a dispute, we reserve the right to suspend or terminate your membership. We encourage you to contact us at hello@joinmailday.com before initiating any dispute with your payment provider.

Refund and Cancellation Policy

All sales are final. MailDay does not offer refunds for any membership fees, including partial months, unused months, or annual plans. If you cancel an annual membership, your membership will remain active through the end of your paid period and will not renew. No refund will be issued for the unused portion.

How to cancel. To cancel your membership, email hello@joinmailday.com. Cancellations are processed manually to protect all parties involved in the pen pal relationship, including your child's matched pen pal. Self-service cancellation is not available. Upon cancellation, your membership will remain active through the end of the current billing cycle and will not renew.

Pausing. Memberships cannot be paused.

Effect of cancellation on your child's pen pal. Because cancellation affects a matched pen pal, we ask that you provide reasonable notice and, where possible, allow your child to send a final letter to their pen pal before the membership ends.

Digital Products

All digital products, including monthly packs and any downloadable content, are non-refundable and non-returnable under any circumstances. All sales are final. It is your responsibility to download and securely back up your purchases. MailDay is not liable for any loss of digital content after delivery.

Rights and Licenses

License to Use the Services. We grant you a non-transferable, non-exclusive right to access and use the Services for your personal, non-commercial use in connection with your child's membership.

Restrictions. You may not license, sell, rent, lease, transfer, assign, distribute, or otherwise commercially exploit the Services or any content delivered through the Services. You may not reproduce, distribute, republish, or transmit any MailDay content, including monthly pack materials, for any purpose other than personal use by your enrolled child.

Intellectual Property. All intellectual property rights in the Services, including the Site, monthly pack content, Poppy Post character, and all associated artwork and materials, are owned by MailDay LLC or its licensors. Nothing in this Agreement transfers any intellectual property rights to you.

Trademarks. MailDay™ and Poppy Post™ are trademarks of MailDay LLC. You are not permitted to use these marks without our prior written consent.

Acceptable Use

By using our Services, you agree that you will not:

Use the Services for any unlawful purpose
Attempt to access another user's account without permission
Provide false or inaccurate information when registering or enrolling
Use any MailDay content, including pack materials, for commercial purposes
Interfere with the proper functioning of the Services
Use the Services in any way that could harm, exploit, or endanger a child

User Content and Feedback

If you provide feedback, comments, or suggestions regarding the Services, you grant MailDay the right to use that feedback in any manner without compensation to you. We will treat any feedback as non-confidential and non-proprietary.

Indemnification

You agree to indemnify and hold harmless MailDay LLC and its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorney's fees) arising out of your use of the Services, your violation of this Agreement, or your violation of any applicable law or regulation.

Disclaimers

THE SERVICES ARE PROVIDED "AS-IS" AND "AS AVAILABLE." MAILDAY EXPRESSLY DISCLAIMS ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MAILDAY MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR REQUIREMENTS.

Limitation of Liability

IN NO EVENT WILL MAILDAY BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THIS AGREEMENT OR YOUR USE OF THE SERVICES. IN NO EVENT WILL MAILDAY'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNTS YOU HAVE PAID TO MAILDAY IN THE PRIOR 12 MONTHS.

Legal Disputes

Governing Law. This Agreement is governed by the laws of the State of Wyoming, without regard to conflict of law principles.

Claim Limitations. Any cause of action arising out of or related to the Services must be commenced within one (1) year after the cause of action accrues.

Agreement to Arbitrate. Any dispute arising out of or relating to this Agreement or the Services will be resolved by binding arbitration under the rules of JAMS Arbitration, rather than in court, except that either party may bring qualifying claims in small claims court in Wyoming. Arbitration will be conducted on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

If for any reason a claim proceeds in court rather than arbitration, it will be brought exclusively in the state or federal courts located in Wyoming.

Term and Termination

This Agreement remains in effect while you use the Services. We may suspend or terminate your account at any time for any violation of this Agreement. Upon termination, your right to access the Services ends immediately.

Copyright Policy

We respect the intellectual property rights of others. If you believe any content on our Site infringes your copyright, please contact us at hello@joinmailday.com with the following information: your contact information, identification of the copyrighted work, identification of the allegedly infringing material, a statement of good faith belief that the use is not authorized, and your signature.

General

Changes to this Agreement. We reserve the right to update these Terms of Use at any time. We will notify you of significant changes by email or prominent notice on our Site. Significant changes take effect 30 days after notice. Continued use of the Services after notice constitutes acceptance of the updated terms.
